Two lawsuits have been dismissed and another has been filed against the Tulsa oral surgeon who officials said could have exposed 7,000 patients or more to HIV, hepatitis B, and hepatitis C.
Graves McLain is representing new plaintiff Stephanie Capraro.
The lawsuit names Harrington; his dental assistants Terri Velega and Lisa Young; Hospira Inc. Pharmaceutical Systems; and Southern Anesthesia & Surgical Inc.
It alleges negligence and carelessness by Harrington and his staff. It also alleges that multiple uses of vials of the anesthetic Propofol, which can cause the transmission of infectious disease, was a foreseeable misuse and that smaller vials should have been distributed.
