In both instances, the dog attack is defined as unprovoked, meaning that it does not apply to instances where a person is intentionally harassing or attempting to injure a dog. It also does not apply to situations in which a person is illegally entering a property for criminal purposes, such as burglary.

A potentially dangerous dog is more specifically defined as:

  • A dog that bites a human without provocation.
  • A dog that severely injures or kills another domestic animal, such as a dog or cat, without provocation

A dangerous dog involves stricter conditions and meets at least one of these criteria:

  • A dog that inflicts extreme injury on a person, such as broken bones, severe lacerations, or puncture wounds. Usually, these dog attacks require multiple sutures or surgery.
  • A dog that has been previously designated a dangerous dog and continues to aggressively bite, attack, or endanger humans.
  • A dog that has been previously labeled as dangerous and then kills or traumatically injures a domestic animal.

Dangerous dogs will be registered as such with the state of Oklahoma. If the owner decides to continue keeping the dog in their home, they must follow certain provisions as directed by the state, specifically:

  • A dangerous dog should be securely confined indoors or in an enclosed and locked pen
  • The securely enclosed structure should provide at least 150 square feet for each dog over 6 months of age
  • The pen should be secure should prevent children from entering and the dog from escaping
  • The pen should have a secure top and sides
  • An outdoor enclosed structure should protect the dog from the elements

The owner of the dog must meet these conditions and maintain liability coverage under their homeowner’s insurance policy to cover any medical bills that future dog bite victims may incur. The coverage should be sufficient to cover medical expenses such as those for cosmetic surgery, serious injuries, disfigurement, and even wrongful death. Otherwise, the dog can be seized by animal control authorities, and the owner fined several hundred dollars for a first offense, and higher amounts plus possible imprisonment for succeeding instances.

What Should I Do After a Dog Bite Attack?

Most dog bites occur without provocation.

Not all dog owners will invest the time and money to properly train their dogs for social situations, and many dogs will react to new people and animals out of fear. Other dogs are naturally more aggressive and may be acting on their natural urges to protect themselves and their owners. Bites or other injuries can cause harm in a matter of seconds that lead to a lifetime of medical treatment.

  • Get away from the dog to safety as quickly as possible.
  • Move to a place away from the attack and call 911 when you are safe.

  • Indicate any witnesses so police can obtain statements.
  • Take or have someone take photos of your injuries, the dog, and the scene of the attack.
